Coup or Reform? The plans to change Israel’s judicial system

Hunderttausende Demonstrant:innen gehen Woche für Woche gegen die Pläne der israelischen Regierung, die Unabhängigkeit und die Kompetenz des israelischen Gerichtshofes zu beschneiden, auf die Straße. Wir möchten Gegnern wie Befürwortern der Änderungen die Gelegenheit bieten, ihre Perspektive darzustellen und danach mit ihnen ins Gespräch kommen. Die Referenten sind:

Prof. Avi Bell, Mitglied der juristischen Fakultät der Bar Ilan Universität und der University of San Diego School of Law und Senior Fellow des Kohelet Policy Forum. Zu seinen Forschungsgebieten gehören das Eigentumsrecht und das Recht des geistigen Eigentums, das Völkerrecht, das Landnutzungsrecht, das Kriegsrecht und der arabisch-israelische Konflikt. Prof. Bell gilt als einer der führenden Forscher in Israel auf dem Gebiet der wirtschaftlichen Analyse des Rechts und ist Mitglied der Israeli Law & Economics Association sowie der American Law & Economics Association. Das Kohelet Policy Forum (gegründet 2012) ist der Think Tank, der maßgeblich hinter den Entwürfen der Regierung steht (s. https://en.kohelet.org.il/policy-papers, z. B. Prof. Yuval Shany, Inhaber des Hersch-Lauterpacht-Lehrstuhls für Völkerrecht an der Hebräischen Universität. Als Experte für humanitäres Recht und Menschenrechte wurde Shany 2018 zum Vorsitzenden des Menschenrechtsausschusses der Vereinten Nationen gewählt, einem wissenschaftlichen Gremium, das die Einhaltung des Internationalen Pakts über bürgerliche und politische Rechte (auch UN-Zivilpakt) durch die Mitgliedsstaaten überwacht. Er ist Senior Fellow des Israel Democracy Institute, ein unabhängiges Forschungs- und Aktionszentrum, das sich seit seiner Gründung 1991 für die Stärkung der Grundlagen der israelischen Demokratie einsetzt. U. A. hat das IDI einen Gegenvorschlag zu dem der Regierung für die Reform des Justizsystems vorgelegt (s. https://en.idi.org.il/articles/47894, Completing Israel’s Constitutional Process).

Hundreds of thousands of demonstrators take to the streets week after week against the Israeli government’s plans to curtail the independence and jurisdiction of the Israeli Court of Justice. We would like to offer opponents as well as supporters of the changes the opportunity to present their perspective and then engage in conversation with them. The speakers are:

Prof. Avi Bell, a member of the Bar Ilan University and University of San Diego School of Law faculty and Senior Fellow of the Kohelet Policy Forum. His research areas include property and intellectual property law, international law, land use law, the law of war and the Arab-Israeli conflict. Prof. Bell is considered one of the leading researchers in Israel in the field of economic analysis of law and is a member of the Israeli Law & Economics Association and the American Law & Economics Association. The Kohelet Policy Forum (founded in 2012) is the think tank significantly behind the government’s designs (see https://en.kohelet.org.il/policy-papers, e.g. Selecting Judges to Constitutional Courts – A Comparative Study).

Prof. Yuval Shany, holder of the Hersch Lauterpacht Chair of International Law at the Hebrew University. An expert on humanitarian law and human rights, Shany was elected in 2018 to chair the United Nations Human Rights Committee, an academic body that monitors member states’ compliance with the International Covenant on Civil and Political Rights (also known as the UN Civil Covenant). He is a Senior Fellow of the Israel Democracy Institute, an independent research and action centre that has worked to strengthen the foundations of Israeli democracy since its founding in 1991.
